Father's Rights Concerns-Here's What You Need to Know About Wage Garnishment

Wage garnishment is a process in which wages from your paycheck are given to your child's custodial parent.  This process occurs if you have unpaid child support monies that the custodial parent is requesting.  If the court authorizes the garnishment of your wages, the sheriff notifies you and your employer of this occurrence.

Even though the garnishment has begun, you still have rights.  You have the right to request a court hearing and make the objections listed below that apply to you and your state.

  • The amount you're being told you owe is incorrect
  • The amount garnished leaves you unable to support yourself
  • The custodial parent is concealing your child
  • You currently have custody of the child or had custody at the time of claim filing 

If you do not have enough money to satisfy the amount you owe, there is a risk of property seizure.  Some types of property eligible for seizure are: cars, motorcycles, boats, houses, stock, and real estate income.
